New Mexico court rules against IPANM in methane regulation case

Mitch Krakauskas Treasurer | Independent Petrolium Association of New Mexico

The New Mexico Court of Appeals has issued a decision regarding the Independent Petroleum Association of New Mexico's (IPANM) legal challenge to the state's Ozone Precursor (Methane) Rule. This ruling comes as part of ongoing debates over regulations aimed at reducing emissions.

In reaction to the court's decision, IPANM expressed its disagreement. The association stated, "We respectfully disagree with the New Mexico Court of Appeals ruling on IPANM’s legal challenge to the Ozone Precursor (Methane) Rule." They emphasized their support for emission reduction goals but criticized certain aspects of the rule. According to IPANM, these provisions threaten a secondary market for marginal wells that could continue producing oil and gas safely.

Jim Winchester, Executive Director of IPANM, voiced concerns about broader regulatory trends in New Mexico. He commented, "Unfortunately, this rule and many other overzealous regulations being pushed out by New Mexico state regulators continue to disproportionately hurt independent operators." Winchester urged state authorities to reconsider their approach towards smaller operators in the region.

IPANM is currently assessing its next steps following this legal setback.
