New Mexico Chief Justice seeks funds for court modernization and security

Chief Justice David Thomson addressed New Mexico lawmakers to discuss the financial needs of the state's court system. During his State of the Judiciary message, Thomson highlighted several areas requiring funding. He noted that while salary increases have attracted more qualified judicial candidates, many lower-paid employees earn less than their counterparts in the executive branch and often qualify for public assistance. The judiciary is seeking $14 million to improve wages for 1,400 employees.

Thomson also emphasized the need for $2.2 million in recurring appropriations to ensure jurors are compensated for their service and requested a one-time $25 million investment to enhance courthouse security. He shared an incident from Gallup where trained court security personnel prevented a kidnapping. Additionally, $3 million is needed to modernize courtroom technology.

Addressing pretrial detention standards, Thomson described it as balancing constitutional rights with public safety needs. Changes by the Supreme Court have led to increased pretrial detentions statewide.

Behavioral health remains a priority, with a $3 million pilot program underway for assisted outpatient treatment (AOT). While early results show some success, comprehensive outcomes are yet to be determined. Thomson stressed funding not only courts but also criminal justice partners like law enforcement and public defenders.

The House Judiciary Committee received briefings on AOT programs and civil commitment laws from Chief Justice Thomson's staff and legal experts Megan Dorsey and Brandon Cummings. They discussed procedures for initiating AOT requests and civil commitments, which require "clear and convincing" evidence of immediate danger or necessity.
