Rebecca Dow, a representative for New Mexico's House District 38, criticized House Bill 255 (HB 255) in a March 14 post on X. She said that the bill "will be a generous supplement from the progressives to tax-free income they earn selling fentanyl in your neighborhood."
"SMH- HB255 In New Mexico, juveniles who commit homicide are about to receive a tax free, 24k basic living income (up to the age of 25," said Dow, State Representative. "This will be a generous supplement from the progressives to tax free income they earn selling fentanyl in your neighborhood."
According to the House Judiciary Committee, HB 255 includes a pilot program offering a stipend of up to $2,000 per month to eligible New Mexico residents under 26 who are former foster children. These individuals must meet certain conditions, such as being enrolled in post-secondary education, an apprenticeship, or a program designed to promote employment and remove employment barriers. The stipend would be individualized based on income and public assistance and could be used for living expenses, including housing.

Dow also highlighted provisions of the Juvenile Restoration Program in another post on March 14. This program aims to assist juveniles convicted of serious crimes in transitioning back into the community after incarceration. Qualifying juveniles could receive up to $2,000 per month for up to four years or until they turn 25. The funding comes from the new Juvenile Restoration Fund. Payments would cease if participants fail to engage in required programs or commit new felonies.
House Bill 255 passed the House on March 8 with a vote of 34-24. Twelve legislators were excused from voting.
Dow is a Republican politician representing Grant, Hidalgo, and Sierra counties. She previously served as a state representative and reclaimed her seat in House District 38 in 2024 by defeating Democratic incumbent Tara Jaramillo. Her campaign focused on pro-business initiatives and education reform.
