Rep. Dow: CYFD's use of confidentiality clause 'should concern everyone'

Rebecca Dow, House Representative of New Mexico, has raised concerns regarding the Children, Youth and Families Department's (CYFD) use of confidentiality clauses. She questioned state spending on communications staff in a statement made on X.

"Very concerning," said Rebecca L. Dow, New Mexico State Representative for 38th District (R). "CYFD often uses the “confidentiality clause” to dodge answers. That clause is designed to protect children and families NOT the government. That should concern everyone."

The CYFD has been under increased scrutiny for transparency and accountability issues, particularly following high-profile youth deaths and concerns about secrecy in handling abuse cases. According to Source New Mexico, the state Attorney General launched a formal investigation in April 2025 to examine systemic problems and potential misuse of confidentiality rules that may hinder public oversight. This investigation has led to renewed bipartisan calls for reform.

According to the official CYFD budget summary released in December 2024, the department’s 2026 budget includes a 6.1% increase over the previous year, partly to expand staff and strengthen communications and public relations. While precise figures for communications staff are not separately listed, the department noted that part of an estimated $25 million overall increase would enhance outreach and transparency.

The Santa Fe Reporter states that since confidentiality clauses were strengthened in New Mexico’s Children’s Code, complaints have increased regarding their use to hide internal investigations and possible misconduct at CYFD. A notable federal complaint was filed in 2023, arguing that broad enforcement of secrecy rules hampers transparency and public trust, prompting proposed legislative reforms.

According to Ballotpedia and official legislative sites, Dow is a Republican who has served as a state representative for New Mexico’s District 38, most recently beginning her term in January 2025. She is known for her background in business and education policy and serves on committees focused on education, rural development, and children’s issues. Dow previously ran for governor in 2022.
