Hamm: 'Every property owner in the county has an obligation to maintain their properties consistent with the county code'

Bernalillo County is trying to enforce a law that cracks down on nuisance properties neglected by their owners.

The law took effect two years ago years ago, according to a report by KRQE, but county officials are currently trying to enforce compliance. The process stems from a 2020 ordinance giving the county authority and allowing a public hearing process rather than using the state’s court resources.

“I would just say that every property owner in the county has an obligation to maintain their properties consistent with the county code.” Nicholas Ham, acting director for Planning and Development Services, told KRQE.

Two code enforcement officers recently went before the county zoning administrator seeking approval to enter and demolish properties they consider unsafe. According to KRQE, property owners also attended the hearing to explain to the nuisance abatement hearing officer their plans to clean up their property.

The hearing officer decides if the property is a nuisance. If not, no further action is needed. If the property is deemed a nuisance, the officer prepares a resolution recommending action for consideration and vote of the Bernalillo County Commission.

“I would say that addressing nuisance property is a priority of the county,” Hamm said.

Planning and Development Services, Hamm said, will pursue the properties that fall within the county’s property nuisance abatement ordinance. Property owners in violation can work with the county to reach a state of compliance. If they don’t the county commission can approve sending in crews to clean up the properties or tear them down.
