New Mexico court upholds conviction in child abuse case

Attorney General Raúl Torrez has commented on the New Mexico Court of Appeals' decision to uphold the conviction of Alexis Avila. Avila was found guilty on April 14, 2023, of first-degree child abuse resulting in great bodily harm. The charges stem from an incident in January 2022 when she attempted to dispose of her newborn baby in a dumpster in Hobbs, New Mexico.

"We are pleased that the New Mexico Court of Appeals upheld justice and reaffirmed the conviction against Ms. Avila for throwing her newborn baby in a dumpster," said Attorney General Raúl Torrez. He added that his office worked with District Attorney Dianna Luce to prosecute the case and expressed relief that the child survived.

The New Mexico Attorney General's office will now focus on ensuring that Avila is returned to custody following this decision.
