Multistate settlement reached with JustFab over alleged deceptive trade practices

New Mexico Attorney General Raúl Torrez has announced a $4.8 million settlement with TechStyle, Inc., also known as JustFab, for alleged unfair and deceptive trade practices. This agreement was reached in collaboration with attorneys general from 34 other states.

The settlement addresses complaints from New Mexicans who reported being unknowingly charged by the online fashion retailer. Allegations against TechStyle included misrepresenting prices, automatically enrolling consumers into membership programs, implementing difficult cancellation policies, and failing to disclose necessary information.

Under the terms of the Assurance of Discontinuance (AOD), TechStyle must reform its business practices and pay restitution to affected parties. "My office is committed to getting money back into the hands of New Mexicans who were overcharged or misled by corporate practices," said Attorney General Raúl Torrez. He added that the settlement not only provides restitution but also forces TechStyle to change its business operations for greater transparency and accountability.

TechStyle operates brands such as JustFab, Shoe Dazzle, and FabKids, offering discounts through a VIP membership program that charges a monthly fee unless customers make a purchase or skip payment via their account. The settlement requires TechStyle to clearly disclose membership terms, obtain informed consent before enrollment, refrain from misleading offers, provide notifications of recurring charges, and offer an easy cancellation process.

Restitution will be provided automatically to consumers enrolled in the VIP program before May 31, 2016, who made only an initial purchase without subsequent transactions or skipped payments. Consumers with unresolved complaints may also receive restitution if they file a new eligible complaint within 90 days of November 1, 2025.

New Mexico's participation in this settlement was part of a broader negotiation led by the District of Columbia and several other states including Pennsylvania and Texas.
