The "Big Beautiful Bill" has sparked strong reactions across the political spectrum. However, amidst the debate, one provision stands out as a potential point of bipartisan agreement: the Educational Choice for Children Act (ECCA).
ECCA proposes a national tax-credit program designed to encourage individual and corporate donations to nonprofit scholarship-granting organizations. In return, donors would receive a 100% non-refundable tax credit. These funds would provide qualifying students with scholarships to attend non-public schools, offering families greater educational choices.
A similar initiative in New Mexico, the Equal Opportunity Scholarship Tax Credit Bill, was introduced in 2024 by Senator Jerry Ortiz y Pino, a Democrat. This bill aimed to establish a state tax credit for donations supporting private school scholarships. Despite the New Mexico Association of Non-public Schools' (NMANS) support, the legislation did not pass, leaving New Mexico among the 29 states without such programs.
Organizations like ACE Scholarships are already assisting low-income families in accessing private education. According to their website, “ACE Scholarships are partial tuition, intended to provide added assistance lower-income families may need to enroll their child in a private school. Standard ACE award amounts are $3,000 for K-8 and $4,000 for high school (9-12). Families are responsible for working out a payment plan with the school for the remainder of the tuition.”
With increased donations, these organizations could expand their reach and impact. National and state tax credit legislation would bolster their efforts, enabling them to serve even more families.
