Woman accused of abandoning infant in trash bin requests visitation: 'We can't predict what she might or might not do'

A Hobbs woman accused of putting her baby in a dumpster is now seeking visitation with the child, according to KOB 4.

Alexis Avila was charged earlier this year with attempted first-degree murder for intentionally dumping her baby in a trash bin and abandoning it, after a security camera captured the incident.

The infant was later discovered and saved from the dumpster by a man who has been hailed as a hero for the act.

Avila is now seeking to have supervised visitation with the child, as well as access to her backyard to see her nieces and nephews, KOB 4 reported.

Her attorneys filed the motion, arguing that she has graduated from high school and sought therapy, and is now enrolled in college to pursue a degree in psychology.

Prosecutors, on the other hand, are opposing the request due to Avila's erratic behavior.

"That baby was found in a trash can, had trash thrown in on top of it, because no one would've known it was a baby," Dianna Luce, attorney for the Fifth Judicial District, said. "Her actions are such that we can't predict what she might or might not do."

Prosecutors said that Avila's ability to graduate from high school without accruing more charges demonstrates that the restrictions are effective and should be maintained.

No hearing has been planned for this request, according to KOB 4.
