Sandoval County authorities are having difficulty applying marijuana laws apply to cases where the violators are minors.
According to KOB News, following a recent incident when students at a Sandoval County elementary school took candy laced with marijuana to school and shared them with approximately two dozen classmates, authorities were left with no avenue to prosecute the parents.
"Right now the laws are a little unclear and we don't have anything specifically criminalizing these acts," Jessica Martinez, chief deputy district attorney of the 13th Judicial District said, according to KOB News.
Due to the recent legalization, law enforcement is not looking to press charges against the parents. However, law enforcement encourages parents to use marijuana responsibly and not to leave it easily accessible to children.
Law enforcement says that although bringing marijuana to school is a misdemeanor, parents might be responsible due to child neglect. However, lawmakers would have to make this a criminal offense in order to charge the parents.
"When laws are made or decriminalized, that's something that the legislature needs to look at," Martinez said. "They need to look at how the new law or new decriminalization of the law is going to affect society and the impacts it can have on it. And this is definitely one."
