New Mexico outlines requirements for posting private property to prevent trespassing

ORGANIZATIONS IN THIS STORY

Questions have arisen regarding the requirements for posting private property in New Mexico. According to Trespass 30-14-6 NMSA, owners, lessees, or lawful possessors of real property in New Mexico—excluding state or federal government-owned land—must post notices along the exterior boundaries of their property. These notices should be placed at each roadway or access point in visible locations. If the property is unfenced, notices must be posted every 500 feet along the boundaries.

Failure to meet these criteria means that Conservation Officers cannot enforce trespassing laws on such properties. This information can be found on page 34 of the Hunting Rules and Information Book provided by the New Mexico Department of Game and Fish.
