The New Mexico Department of Workforce Solutions has announced a public hearing scheduled for September 3, 2025, at 10:00 am. The hearing will take place in the conference room of the Human Rights Bureau at 1596 Pacheco St Suite 103, Santa Fe, New Mexico. The purpose is to gather input and comments on a proposed rule addition concerning industrial revenue bonds.
The new rule aims to define regulations for applying prevailing wage rates for laborers and mechanics working under local government industrial revenue bonds. It includes procedures for wage predetermination, job classification descriptions, and enforcement of the Public Works Minimum Wage Act (PWMWA) and aligns with the Public Works Apprenticeship and Training Act (PWAT).
According to NMSA 1978 §13-4-11(J), the director of the Labor Relations Division has the authority to issue necessary rules for administering the PWMWA. Similarly, under NMSA 1978 §13-4D-4(C), the department can adopt rules to implement provisions of the PWAT.
Interested parties may testify at the hearing or submit written comments by September 2, 2025, addressed to Andrea Christman at P.O. Box 1928, Albuquerque, NM. Written comments are encouraged as soon as possible. Proposed rules can be accessed online or obtained by contacting Andrea Christman via phone or email.
