I. CALL TO ORDER

The special meeting of the Governing Body was called to order by Mayor Webber at 5:36 pm, on Wednesday, February 7, 2024, in the Council Chambers, City Hall, 200 Lincoln Avenue, Santa Fe, New Mexico.

2. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Councilor Lindell.

3. SALUTE TO THE NEW MEXICO FLAG

The salute to the New Mexico Flag was led by Councilor Michael Garcia.

4. INVOCATION AND REMEMBRANCES

The invocation was given by Councilor Castro.

A moment of silence was given.

6. APPROVAL OF AGENDA

MOTION A motion was made by Councilor Michael Garcia, seconded by Councilor Lee Garcia, to approve the agenda as presented.

VOTE The motion passed on a voice vote.

7. PUBLIC HEARINGS (LAND USE CASES, APPEALS, AND OTHER ITEMS REQUIRED TO HAVE A PUBLIC HEARING)

A. CASE #2023-7297-APPL OLD PECOS TRAIL. APPELLANTS ANNIE CAMPBELL, MARK BAKER, ROBERT JOSEPHS, CHRISTOPHER WORLAND, STEVEN CLARK, LUCIA DEICHMANN, AND TOM HALL, BY AND THROUGH THEIR AGENT, BRUCE THRONE, APPEAL THE PLANNING COMMISSION’S DECISION TO APPROVE A FINAL SUBDIVISION PLAT FOR A 25-LOT RESIDENTIAL SUBDIVISION LOCATED AT 2200 OLD PECOS TRAIL. POSTPONED FROM THE JANUARY 31, 2024 REGULAR GOVERNING BODY MEETING

Mayor Webber stated the process for the hearing including opening statements, sworn testimony, cross examination, public comments, questions from the Councilors, sworn testimony, cross examination, public comments, questions from the Councilors, closing arguments and Council debate and determination.

Mayor Webber called the Public Hearing to order at 5:51 pm.

The process began.

SWORN PUBLIC COMMENT:

Peter Ives. Mr. Ives spoke to items within the code and issues with the final plat.

Oralynn Ortiz.. Ms. Ortiz spoke to changes from the original plat to the final plat.

Patricia Lillis. Ms. Lillis spoke in support of the appeal.

Hilario Romero. Mr. Romero spoke to the short time given to the public to speak and the Land Use Department not being as cooperative with the community as they were previously.

Monica Montoya. Ms. Montoya spoke to the City of Santa Fe development review process being expensive and extensive.

Steven Farber. Mr. Farber spoke to due process of law as a key component of the hearing and equal application of laws and Ordinances.

Adam Johnson. Mr. Johnson spoke to due process issues and that the process can be improved.

Stephanie Beninato. Ms. Beninato spoke to open space issues and non relevant comments and repetitive comments.

Diane McGinnis. Ms. McGinnis spoke in support for the appeal.

MOTION A motion was made by Councilor Cassutt, seconded by Councilor Castro, to suspend the rules and allow the meeting to extend beyond 11:30 pm.

VOTE The motion passed on a roll call vote as follows:

Councilor Castro, yes; Councilor Cassutt, yes; Councilor Lee Garcia, yes; Councilor Michael Garcia, yes; Councilor Lindell, no; Councilor Romero-Wirth, yes, Mayor Webber, yes.

The process continued.

Mayor Webber closed the Public Hearing at 12:41 am.

MOTION A motion was made by Councilor Romero-Wirth, seconded by Councilor Cassutt, to modify the Planning Commission's approval of the final subdivision plat by asking that the walls and fences prohibitive section be moved to the final plat; that the open space requirements be listed and moved to the final plat; that the open space requirements be listed and that it be noted on the plat that the subdivision has to comply with both provisions; that the 50% overlay is required and the private open space provision is listed on the plat as a requirement; that it be noted on the plat that parapets and pitched roofs are included in the height restriction; and that the provision that requires lighting listed on plat be removed. With those revisions, we approve the final subdivision plat as modified and direct staff to formulate the findings of fact and conclusions of law from this decision.
