'Obvious hazards to employees regarding the use of firearms': New Mexico fines Rust Movie Productions following fatal shooting investigation

The state of New Mexico fined Rust Movie Productions due to the fatal shooting of a production member by actor and producer Alec Baldwin in October 2021.

The New Mexico Occupational Health and Safety Bureau (NM OHSA) on Wednesday issued a fine of nearly $137,000, the maximum that could be imposed on the production company. Regulators found a series of safety issues during an investigation into the scene of the crime, according to KOB 4.

"What we had, based on our investigators' findings, was a set of obvious hazards to employees regarding the use of firearms and management’s failure to act upon those obvious hazards,” Bob Genoway, bureau chief for NM OHSA, told The Associated Press, as reported by KOB 4.

Baldwin in October 2021 was pointing a gun at cinematographer Halyna Hutchins inside a small church set just outside of Santa Fe when the gun fired. The gunshot killed Hutchins and wounded the film's director, Joel Souza.

The investigation that followed found an abundance of gross ignorance of safety, including two misfires prior to the shooting and a lack of safety protocol by the crew, according to KOB 4. The NM OHSA also found that firearms on set often were left unattended.

In addition to the fine imposed on the company, police and local prosecutors are supposedly looking into pressing criminal charges, KOB 4 reported.
