Former Bernalillo County deputy convicted of kicking suspect asks for early end to probation

A former Bernalillo County Sheriff's deputy who avoided serving jail time after he was convicted of kicking a suspect in the face has now asked a judge to release him from probation a year early. 

According to KRQE, at the time of sentencing prosecutors had asked the court to impose a three-year prison sentence for former Sgt. David Priemazon, but the judge opted for a deferred sentence of three years probation and 100 hours of community service. 

"I believe the defendant would be better able to provide for his family and to be an asset to the community by remaining out of custody," Judge Daniel Gallegos said during Priemazon's sentencing hearing in 2019. 

Priemazon was found guilty of aggravated battery for roughing up Christopher Lucero, a suspected car thief, during a traffic stop three years ago, according to KRQE. Priemazon asked his request be granted based on the fact that he's not only completed all the requirements of his probation, but has also been able to keep a job and support his family. 

If the judge doesn't sign off on an early release from supervised probation, it would be up at the end of next year.
