Beginning November 1, new federal requirements will alter how energy assistance is factored into the calculation of Supplemental Nutrition Assistance Program (SNAP) benefits for over 32,000 New Mexicans. This change is mandated by federal law HR1 and affects the application of energy assistance payments during SNAP eligibility assessments.
The New Mexico Human Services Department (HSD) is assisting SNAP recipients in understanding and preparing for these changes to ensure that households still eligible for the energy expense deduction continue to receive it. Niki Kozlowski, director of HSD's Income Support Division, said, "We’re communicating early to give families time to prepare." She advised those uncertain about the impact of this change on their benefits to contact HSD before their next renewal.
For households with members aged 60 or older or individuals with disabilities, the Heating and Cooling Standard Utility Allowance will remain applicable if they receive aid from programs like the Low Income Home Energy Assistance Program (LIHEAP). These payments will not be considered income when calculating SNAP benefits.
However, households without older adults or people with disabilities must inform HSD if they pay their own heating or cooling bills. Proof may be required in the form of a utility bill, lease agreement, or a letter from a landlord. Simply receiving LIHEAP will no longer qualify such households for the utility deduction. If another party pays utilities, that amount will be counted as income, disqualifying them from the deduction.
The new rule applies to applications or renewals submitted on or after November 1. Current SNAP benefits remain unchanged until then. This adjustment may lead some individuals and families to lose the standard deduction for heating and cooling costs, potentially reducing monthly SNAP benefits.
