New Mexico AG halts illegal lien filings on Albuquerque homes

The New Mexico Department of Justice has taken action against Boreworxx Construction, LLC for illegally filing liens on nearly 200 homes in Albuquerque. The company filed these liens, valued at approximately $2 million, as a tactic to pressure Circet USA into paying for fiber optic work that was allegedly not completed satisfactorily.

The investigation by the NMDOJ found that Boreworxx used these liens to coerce homeowners into complaining about the unpaid contract. Boreworxx had been subcontracted by Circet USA to enhance internet services in Albuquerque's city-owned areas. When Circet USA withheld payment due to alleged unsatisfactory work, Boreworxx responded with the illegal liens.

Attorney General Raúl Torrez said, "We will not tolerate abusive scare tactics or unethical behavior by businesses in this community." He credited prompt reporting by community members and the City of Albuquerque for enabling swift action.

As part of an Assurance of Discontinuance (AOD) agreement, Jeffery Dailey, operator of Boreworxx, is prohibited from future misconduct. The agreement requires Dailey and Boreworxx to stop communicating with affected homeowners and provide a list of all individuals who received lien-related correspondence. They must also preserve all related documents and information.
