Tenth Circuit strikes down New Mexico's 7-day firearm purchase waiting period

The New Mexico Shooting Sports Association (NMSSA) has expressed approval of a recent decision by the United States Court of Appeals for the Tenth Circuit. The court struck down New Mexico's 7-day waiting period for firearm purchases, which NMSSA has long opposed as unconstitutional.

The ruling, issued on August 19, 2025, was welcomed by NMSSA as it aligns with their stance that the Second Amendment protects citizens' rights to acquire firearms without undue delays. Anthony Segura, Executive Director of NMSSA, said, "This is a victory for freedom and every law-abiding gun owner in New Mexico." He emphasized that the decision underscores the Second Amendment's protection against what he described as "needless and unconstitutional waiting periods."

NMSSA has consistently argued that such waiting periods do not enhance public safety but instead impose unnecessary burdens on responsible gun owners. Segura noted that criminals typically do not adhere to these laws and delaying access to firearms could jeopardize individuals needing immediate protection.

Segura further urged state leaders to redirect their focus from targeting lawful gun owners to addressing actual crime solutions. "With yesterday’s ruling, New Mexicans are once again treated with the respect and trust they deserve," he added.

The association remains committed to opposing restrictions they view as unconstitutional and continues its advocacy for the rights of New Mexicans to keep and bear arms.
