New Mexico DOJ secures $350K settlement over alleged unfair practices at Santa Fe Spa

The New Mexico Department of Justice (NMDOJ) has reached a $350,000 settlement with Santa Fe Spa Center, also known as Voupre Spa or SHM Group 2019, Inc., following allegations of unfair business practices. Attorney General Raúl Torrez initiated the lawsuit in 2024, accusing the spa and its owners of violating the Unfair Practices Act by employing aggressive and deceptive sales tactics. These practices reportedly led to customers being charged double or triple the agreed-upon prices.

Attorney General Raúl Torrez said, "Our Department has been hard at work on this case, and we are proud to return money to consumers who were targeted and financially harmed." He emphasized that both visitors and locals should not face exorbitant charges or high-pressure sales tactics designed to mislead them into purchasing unwanted products. "This case underscores our commitment to protecting consumers in New Mexico and holding bad actors fully accountable for exploiting our communities," he added.

The NMDOJ will contact individuals who have already filed complaints regarding the spa. Those who believe they were affected can submit claims for restitution by providing documentation of payment discrepancies. Claims must be submitted before February 10, 2026.

As part of the settlement, defendants are required to pay $350,000 in restitution. They must ensure transparent pricing for all products and services and complete transactions within retail locations. Additionally, they are obligated to provide itemized receipts and maintain a reasonable return policy compliant with the Unfair Practices Act.

Defendants must also notify the NMDOJ within 30 days if there is any change in business name or branding that could affect consumer recognition.

The NMDOJ encourages anyone who believes they have been defrauded by a business entity in New Mexico to submit a complaint through their website.
