New Mexico joins lawsuit over electric vehicle mandate repeal

ORGANIZATIONS IN THIS STORY

New Mexico has joined a federal lawsuit concerning the repeal of an electric vehicle (EV) mandate. In 2023, the state's Governor, through the Environmental Improvement Board, introduced a plan requiring 43% of vehicles sold to be electric. Currently, only about 5% of cars sold in New Mexico are EVs. No state has reached the 43% target; Colorado leads with 26.4% EV sales.

Despite bipartisan congressional votes and President Trump's approval to remove states' ability to adopt California's EV mandates, New Mexico is joining California in legal action to maintain its mandate. The lawsuit involves the Congressional Review Act. It remains uncertain how judges will respond to this issue.

Governor Lujan Grisham's support for maintaining the mandate aligns with her previous positions on vehicle regulations.
