New Mexico has taken a significant step towards empowering individuals with disabilities and older adults by introducing the Supported Decision-Making Act, which has been signed into law by the governor. As part of SB 535, this act aims to provide alternative pathways for individuals requiring assistance in making personal decisions while maintaining their independence.
The Supported Decision-Making Act will establish a new program within the Office of Guardianship. It is designed to foster supported decision-making agreements as an alternative to adult guardianship. The New Mexico Aging and Long-Term Services Department (ALTSD) will work alongside the Office of Guardianship to facilitate access to these resources for interested individuals.
"Providing more pathways to autonomy and self-determination strengthens our communities," said Emily Kaltenbach, ALTSD Cabinet Secretary. "This legislation will help ensure that those who need it have the necessary support to make informed decisions while maintaining their independence and dignity."
More than half of the United States, including Texas, Colorado, and Arizona, have already adopted supported decision-making as a legal alternative to guardianship. This approach enables individuals to retain decision-making authority with necessary assistance.
"Too often people with disabilities do not have a voice when making decisions, which prevents them from learning necessary skills and gaining free will," noted Vashad Frink, a disability rights advocate and supported decision-making ambassador. "The Supported Decision-Making Act will help ensure people with disabilities like me have the same rights and respect as everyone else."
The ALTSD and the Office of Guardianship thanked the sponsors, legislative supporters, and community partners involved in advancing this legislation. Their efforts are directed towards ensuring that more New Mexicans can experience independent and self-determined lives.
