The New Mexico Children, Youth, and Families Department (CYFD) has expressed concerns over the potential impact of underfunding in the House budget proposal on child welfare services. The department announced in a press release on February 24, 2025, that the shortfall could lead to federal penalties.
According to the CYFD press release, the House has allocated only $1.79 million of the $62 million needed for recurring funding. This leaves a significant gap that jeopardizes essential child welfare services. The proposed budget also fails to address a $12.3 million deficiency and a $20 million supplemental funding gap, which could severely affect the department's ability to meet requirements under the Kevin S. Settlement Agreement. Among the unfunded needs are increased foster family support, additional case aid positions, and the establishment of a regional emergency response team.
The House has provided $30 million in non-recurring funding over three years for positions tied to the Kevin S. Settlement Agreement. However, CYFD notes that this funding is insufficient as it does not cover necessary items such as training positions for child welfare workers and foster family recruitment specialists.
"This dramatic shortfall threatens New Mexico’s ability to protect our most vulnerable children and families," said CYFD Secretary Teresa Casados in the press release. "Without adequate funding, we face the very real possibility of reducing services and facing costly penalties for non-compliance with court-mandated improvements. We are working day and night to strengthen our child welfare system and improving the agency, but fiscally restraining CYFD only hinders the state's progress."
